Standard Terms and Conditions of Sale

1. Scope of application
1.1 The following "General terms and conditions of sale" are valid for purchase contracts for goods between any natural and legal person (hereinafter "Buyer") and the Seller, which are concluded via the online store at https://saintbones.com or any other way belonging to Saint Bones Handels GmbH. Saint Bones, on behalf of Saint Bones Handels GmbH and / or all other legal entities within the Saint Bones Handels GmbH group of companies are hereinafter referred to as "Saint Bones" / We / Us / Our(s)". Please read these terms and conditions carefully before ordering Products (as defined below) from the Website. By ordering our products, you agree to our

1.2 The Seller - Saint Bones Handels GmbH, with registered office at Felberstr.82, 1150 Vienna, (hereinafter referred to as "Seller" or "Saint Bones"), sells hereinafter referred to as "goods" or "object of purchase" or “item” or “product”, on the online sales platform https://saintbones.com and any other online platform belonging to the seller.
1.3 Modification of Term and conditions: We retain the right to modify our terms and conditions at any time. Updated terms and conditions will be effective immediately upon being posted on our website. Any purchase agreement between you and Saint Bones will be governed by the version of the terms and conditions that is published on our website at the time when the order is placed.
2. Purchase process and orders
2.1 The Buyer can place an order by selecting the goods in the store, placing them in the shopping cart and completing the ordering process.
2.2 By clicking the checkout process you conclude a binding contract with Saint Bones.
2.3 Before you place the order, you can verify your data and choose the payment method.
2.4 Item`s availability, prices and delivery options may vary depending on the delivery location.
2.5 There may be differences in the manufacturing processes, materials and display characteristics of the computer hardware you use to explore the website. The colors and textures of the products displayed on the website, as well as the colors and texture of the delivered products may slightly differ.
2.6 After placing the order, you will receive an automated E-Mail from us confirming that we have received your order. Do make sure to check also your spam folder for the conformation E-Mail.
2.7 The purchase agreement will be considered finalized once the Seller sends a fulfilment notification E-Mail to the Buyer indicating that the products have been shipped.
2.8 We provide the "Buy Online & Pick Up in Store" option at our Wien-Am Hof 12 showroom. After the order is paid, you will receive an E-Mail confirmation that the ordered products are available for Pick up at the designated location.
2.9 All orders placed by you are subject to our acceptance. We reserve the right NOT to accept an order without giving any reason and without liability under applicable law. For example, we may NOT accept an order if:
A) there is reason to believe that you are not in compliance with the T&S
B) an order appears suspicious or fraudulent, or you are involved in fraudulent or criminal activity of any kind.
C) the products displayed on the Website are unavailable
D) the products on the Website are incorrectly priced and/or incorrectly described.
E) your payment has not been authorized and/or has been declined or if there is an open chargeback.
3. Availability of the goods and delivery
3.1 The availability of each product type and model is determined individually, and can be viewed in the online store. Some products may not be immediately available and have a longer delivery time as they are produced upon order. Personalized merchandise will be made available upon request. Please note that we reserve the right to amend description, price, photos, design or any other significant or insignificant details related tot he product without prior notice. If a product you ordered is permanently unavailable or fulfilment is not possible, you will be notified during the ordering process and refunded via the payment method used for the purchase.
3.2 The Seller is responsible for delivering the goods to the Buyer within the timeframe specified in the store, except for
- delays due to extended production times
- or material shortages.
3.3 The risk of loss or damage to the goods shall pass to the Buyer upon delivery.
3.4 Buy Online & Pick Up in Store/ Click & Collect: We can offer you the option to buy a product online and then pick it up in our showroom in Wien-Am Hof 12. The product will normally be ready for pick up in our showroom within 24 hours. The order will be held for 30 working days. When picking up the goods, the customer must be able to identify themselves with a photo ID. If the goods are to be picked up by a third person, the customer is obliged to inform us in advance by e-mail and, if necessary, to issue an authorization.
3.5 Upon collection and receipt of the product, the risk of damage or loss of the product is transferred to you
3.6 Products collected personally at the showroom are not subject for 14-days return & refund policy.
3.7 The Seller reserves the right to arrange delivery from any location of his choice. Fulfilment and delivery locations are not limited to Austria.
3.8 When the order is placed from out of the European Union and/or delivery address is located outside the European Union, certain importing duties and charges might be applied by national customs other authorities. Depending on the jurisdiction, the Buyer might be requested to provide certain documents (like governmental issued ID) and pay duties directly or via agent.
3.9 All importing & related charges are the Buyer's sole responsibility unless explicitly confirmed in writing by the Seller.
4. Prices and payment
4.1 The prices displayed in the store include the VAT, but not possible shipping charges (if applicable). The prices do not include importing fees, taxes and other charges related to out-of-the-EU deliveries.
4.2 The payment methods available to the Buyer depend on the jurisdiction and billing address oft he Buyer. You can see the whole list of options at the payment stage oft he checkout process.
4.3 The Seller reserves the right to change the prices and payment methods at any time without prior notification.
4.4 The total amount of the order, including additional and shipping costs, will be displayed at the end of the check-out process. By confirming the order, you agree to the price. After the order process is completed, the price cannot be adjusted/changed.
4.5 If you order from abroad (i.e., non-EU area), your bank or payment provider may charge other international bank fees or currency exchange fees. The final price will be calculated and charged in the currency of your card/bank/payment method. Saint Bones has no control over the amount of these fees and will not refund these fees in any case. Please note that it is important to be aware of the currency that your card issuer or bank charges in. Saint Bones will not be held liable for any charges, fees, or other liabilities resulting from currency conversion. To avoid any unexpected fees, we advise checking with your bank in advance for details regarding currency conversion fees.
4.6 The name and address of the invoice recipient must match the details on the payment card or any other payment method for security reasons. We reserve the right to cancel any order that does not meet security standards.
4.7 If the price of an item is changed by the Seller to a lower price, the Buyer who purchased this specific item at a higher price is eligible for a partial refund of the price difference. The present policy is valid for the orders that were placed within 14 days before the price change and does not apply to sales, special offers, and/or any promotional events.
4.8 If the price change is related to Black Friday or 11.11 sales specifically, the customers who placed orders within 5 days before the sale are eligible for partial refund of the price difference.
5. Right of withdrawal and return
5.1 The Buyer has the right to withdraw from the purchase contract within 14 calendar days after receiving the goods without any given reason.
5.2 The Buyer must inform the Seller by e-mail about his decision to return the goods. Returns shipped without prior notification will not be accepted.
5.3 The buyer is responsible for returning the goods to Saint Bones in their original condition and original packaging. The full set of delivery must be present.
5.4 Used, worn, or damaged products will not be accepted for return and refund. Products with removed seals (where applicable) will not be accepted.
5.5 For the return of the product, please, contact us at customer@saintbones.com for instructions.
5.6 The Buyer is responsible fort he costs oft he return shipment. To avoid long processing time and risks, please, send the returns with tracking only. Make sure to choise a suitable shipping method that is cost effective for you. The return shipping fees will not be reimbursed.
5.7 After receiving and examination of the returned good for eligibility, the seller will issue a full refund of the purchase price within 14 days. The refund will be processed using the same payment method that was used for the original purchase. Please note that return shipping fees will not be refunded. Additionally, personalized products cannot be returned or exchanged.
5.8 Bespoke, custom-made, engraved products or products personilized in any way upon Buyer’s request cannot be returned or exchanged.
6.Warranty and liability
6.1 The Seller warrants that the goods will conform to the description given in the shop and will be free from eye-visible defects in material or workmanship, provided they are subject to normal use.
6.2 The warranty doesn’t cover microscopic defects or traces of finishing occuring due to the nature of specific material or production process that are visible only with significant magnification or microscope.
6.3 The warranty period is two years from the date of receipt of the goods.
6.4 The warranty does not cover damage to the products resulting from accidents, misuse or abuse, alterations, attempted repairs and refinishing, post-purchase negligence, normal wear and tear, and/or failure to follow product care instructions.
If your product(s) is found to be defective under this warranty, please contact us at customer@saintbones.com.
6.5 Additionally, the warranty for the watches produced and offered by Saint Bones does not cover damage resulting from wearing the watch while performing any kind of sports or intense physical activity and resulting from water damage.
6.6 Liability limitations: Saint Bones will only be liable for damages caused intentionally or by gross negligence and will not be responsible for the suitability of our products for your specific needs. We will not be liable for any economic loss (including loss of income, profit, contracts, business or anticipated savings), loss of data, loss of goodwill, or loss of reputation. Please note that Saint Bones will also not be held liable for any damages to life, body, or health or damages resulting from fraud or deceit.
6.7 Our products are purely decorative and free from any radical religious content or ulterior motives. We do not intend to make any religious comparisons or misinterpretations.
6.8 Saint Bones has no affiliation of any kind with Rolex SA or any other Swiss watch brands. Third-party trademarks belong to their respective owners.
7. Data protection and privacy
7.1 The Seller collects and processes the Buyer's personal data in accordance with the applicable data protection laws.
7.2 The Seller shall use the Buyer's personal data exclusively for the purpose of fulfilling the purchase contract.
7.3 The Buyer has the right to access, correct and delete his personal data at any time.
8.Intellectual property
8.1 Intellectual property rights, including copyright, in all content displayed on the shop belongs to the Seller.
8.2 You are free to browse the content on the sites, but downloading, viewing or using the content from the sites is permitted only for your personal, non-commercial use.
8.2 The Buyer or any other party may not use, reproduce or modify any content of the shop without the prior written consent of the Seller, nor may you incorporate the websites or their content into other websites, online platforms or similar facilities.
9. Governing law and dispute resolution
9.1 These terms shall be governed by and construed in accordance with the laws of the Federal Republic of Austria.
9.2 Any disputes arising out of or in connection with these terms shall be resolved by the courts of Vienna, Austria.
